1. Payment channels and fund segregation
Brand-side payments and Creator-side compensation transfers are processed through licensed payment service providers such as Airwallex. BeeMatch.AI itself does not hold or custody Brand funds; Platform wallet balances are held by the payment service provider in accordance with applicable licensing requirements.
The rights and obligations between the Brand and a payment service provider are governed by the agreements each party enters into with that payment service provider.
2. Balance withdrawal
The Brand may withdraw its account balance at any time. A third-party payment platform may charge transaction service fees under its terms; cost sharing follows the Platform’s publicly available rules.
3. Creator non-delivery
If a Creator fails to deliver conforming Creative Content as agreed, including failure to publish on time or submit required deliverables, the Brand may obtain usage rights to Creative Content already produced within the scope stated in the applicable Campaign Information or final Order Details.
4. Brand cancellation and compensation
If a Campaign cannot be completed for reasons attributable to the Brand, the Platform may compensate the Creator according to the current delivery stage:
- If the script or draft has been uploaded but final delivery becomes impossible because the Brand failed to review on time or cancelled the Campaign, the Platform may retain 30% of the corresponding Quotation as cancellation compensation.
- If the final link has been uploaded but the Brand does not use the deliverable without reasonable cause, the Platform may retain 50% of the corresponding Quotation as cancellation compensation.
- After deducting the applicable compensation, any remaining amount will be automatically returned to the Brand through the original payment channel.
5. Sample returns and related costs
If the Creator has received a sample but refuses to deliver, delivers late, or cannot deliver conforming content, the Creator shall return the sample to the Brand and bear the related costs, including sample loss, shipping, and handling fees. BeeMatch.AI will coordinate and supervise the process.
6. Promotional credits
Promotional Credits are non-cash, do not bear interest, and may not be withdrawn, redeemed for cash, or transferred. They may only be used to offset eligible amounts in accordance with the applicable Platform rules. Credits used for any single order may not exceed 5% of that order’s Quotation.
If the Brand cancels a Campaign or elects a refund in whole or in part, Credits previously awarded, unlocked, matched, or applied will be rescinded, voided, or clawed back in accordance with the Credit Rules and Platform settings then in effect.
7. Governing law and dispute resolution
This Policy and the related Terms are governed by the laws of the Hong Kong Special Administrative Region, excluding its conflict-of-laws rules.
Any dispute arising from or related to the relevant terms that cannot be resolved through negotiation shall be submitted to a court of competent jurisdiction in the Hong Kong Special Administrative Region.
